Part A: Website Terms of Use

2. Intellectual Property

All content on this website, including text, graphics, logos, architecture diagrams, and software descriptions, is the property of Fluidika s.r.o. and is protected by international copyright laws. You may not reproduce, copy, or distribute any part of this website without our prior written permission.

3. Limitation of Liability

The information provided on this website is for general informational purposes. While we strive for accuracy, we make no warranties regarding the completeness or reliability of the content. Fluidika s.r.o. shall not be liable for any direct or indirect damages arising from your use of this website.

Part B: Software Product Licensing and Sales

The following terms apply to the purchase and use of our standalone engineering software products (Windows Applications, Excel Add-Ins, MATLAB Libraries, and C++ DLLs).

1. FastSpring as Merchant of Record

Fluidika uses FastSpring as our authorized reseller and Merchant of Record. When you purchase a software product from our website, your legal transaction, payment processing, tax calculation, and invoicing are conducted entirely with FastSpring, under FastSpring's Terms of Sale. Fluidika does not collect, process, or store your credit card information. Any requests for refunds or payment disputes must be handled in accordance with FastSpring's policies.

2. License Grant

Upon purchase, Fluidika grants you a non-exclusive, non-transferable license to install and use the software in accordance with the specific license tier purchased (e.g., Single Installation, Commercial Use, or Redistribution License).

3. Restrictions

Unless explicitly permitted by a specific Redistribution License, you may not:

• Reverse engineer, decompile, or disassemble the software.

• Sublicense, rent, lease, or distribute the software or your license key to third parties.

• Use the software to create a competing product.

4. Warranty and Support

Our software implements complex numerical methods and international standards (e.g., IAPWS-IF97, ASHRAE, CTI ATC-105). While we validate our implementations rigorously against reference data, the software is provided "as is" without warranty of fitness for a particular purpose. You, as the engineer or user, retain ultimate responsibility for any design, control decision, or system built relying on our calculations. Standard licenses include one (1) year of email support and minor upgrades, as detailed on the product pages.

Part C: MES and Industrial AI Services

1. Separate Contractual Agreements

Our bespoke Manufacturing Execution Systems (MES) and Industrial AI solutions are highly customized B2B engagements. These services are not governed by the terms on this website. Instead, they are governed entirely by the specific, negotiated Service Agreements, Statements of Work, and Data Processing Agreements (DPAs) signed directly between Fluidika s.r.o. and your organization.

2. Platform Intellectual Property

As detailed on our Service Model page, Fluidika s.r.o. retains all intellectual property rights to the core platform, its source code, and underlying data models used in our MES and AI deployments. Clients are granted a right to operate the system subject to the active service agreement.
